Information on the processing of personal data for website users - GDPR

This notice (Notice) regards the processing of personal data of the users of Sidler SA website at www.sidler-sa.ch (the Website).

This Notice shall not be applicable to third party’s websites, applications and contents in general, not even if they are accessible from the Website. In these cases the personal data protection policy of said third party shall be applicable, which may be different from this privacy policy and which we recommend you to consult before providing any data.

This Notice shall not be applicable to applicants for employment in relation to the job offers reported on the Website: applicants’ data shall be processed in compliance with the notice as specified in section “Unsolicited application” and with the procedure to be used to send the CVs online.

1.      Data Controller.

For the purposes hereof, the data controller is Sidler SA, with registered office in Via Gaggiolo 27, 6855 Stabio CH, with business register number CHE-100.591.903 VAT (Data Controller). 

The Data Controller is a company operating in the recruitment sector.

2.      Data collected.

Your personal data – collected through your access to the Website or when requests are sent to the dedicated address – are limited to the data required for the use of the Website by users, and to the data required to reply to any request sent by users (hereinafter jointly referred to as Data). 

The IT systems and software procedures used for the Website, while they are operating, acquire some personal data which is implicitly provided in using the Internet, based on the TCP/IP protocol.

This is any information that is not collected to be associated to identified data subjects, but that, due its nature, may allow to identify the internet users by processing and associating the relevant data with data held by third parties.

This category of data includes: the “IP addresses” or domain names of the computers used by the users connecting to the website, the URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used in submitting the request to the web server, the size of the file received in the reply, the numeric code indicating the status of the reply provided by the web server (successful, error, etc.) and other parameters relating to the operating system and to the computer environment of the users accessing the website. 

Such data are used only for the purpose of obtaining anonymous statistical information about the use of the Website and checking for the proper operation of the Website so as to ensure its utilization by users. 

3.      Legal basis and purpose of data processing.

The legal basis of Data processing is the response to your request.

Data will be processed exclusively for the purpose of replying to any request you have made through the Website.

Providing Data for the aforementioned purposes is compulsory and necessary. Any refusal, full or partial, to provide Data shall not enable to the Data Controller to reply to the requests in relation to which Data is collected.

4.      Data processing.

Data will be processed by employees and/or collaborators of the Data Controller, duly appointed as persons authorised to data processing  and external data processors, whose names are available upon request made to Data Controller.

The Data Controller and the third parties on whom the Data Controller relies process Data by manual processing or electronic or computerized tools, according to procedures strictly related to the same purposes and, in any case, in such a way to guarantee Data security and confidentiality. 

For the purposes hereof, your personal data will be processed and kept outside the European Union, namely in Switzerland, where the Data Controller has its registered office and where the data processors appointed by the Data Controller have their registered office. 

In any case, your data will be processed exclusively in Non-EU countries providing adequate data protection pursuant to the rules of the European Institutions, as it takes place in Switzerland, in relation to which the European Commission adopted the Decision of 26 July 2000 on the adequacy of personal data protection in Switzerland pursuant to directive 95/46/EC. 

5.      Data notification and Data recipients. 

Data may be notified to third parties only if this is necessary to answer any request for information you have sent through the Website to the Data Controller. 

Third party Data recipients, independent data processors or duly appointed as data processors, belong to categories including subjects who perform, on behalf of the Data Controller or for the Data Controller, technical and organizational services or professional assistance/consulting services, namely the administrators of the software infrastructure used by the Data Controller.

6.      Data disclosure. 

Data shall not be disclosed.

7.      Data retention period

Data is processed only for the time strictly required to pursue the purposes for which it has been collected and, in any case, no more than 24 (twenty-four) months from the reception of any request.

Rights of the data subject. 

The Data subjects are entitled at any time: (I) to obtain confirmation of the existence or non-existence of their personal data; (II) to know the purposes and terms of data processing, the recipients of such Data, the data retention period; (III) to obtain personal data rectification or erasure and, if applicable, restriction of processing; (IV) to object to processing; (V) if applicable, to receive their personal data provided to the Data Controller in a structured, commonly used, machine-readable format and send it to another data controller without any impediment by the Data Controller;  (VI)  to file any complaint to the Personal Data Protection Authority.

The aforementioned rights may be exercised at any time upon request, to be sent to the Data Controller:
